Sewer Connection Fee

“WHEREAS, the City of Fontana has conducted an extensive analysis of its capital facilities, the costs reasonably borne by the City in constructing those facilities, the beneficiaries of these services, and the revenues produced by those paying fees and charges for capital facilities; and”

“Sewer Connection – Fund 702 — The purpose of the fee, the relationship between the fee and the purpose, the sources of anticipated funding and the approximate dates on which funding is expected are set forth in the City's most recent Capital Improvement Plan for Fiscal Years 2023/2024 – 2029/2030, which is incorporated herein by reference. In order to fund the San Bernardino Trunk Sewer project, $8,322,304 was borrowed from the State Revolving Loan Fund. The loan repayment is equal to $502,241 per year. Sewer connection fees are obligated for one-half of this annual repayment amount.”

“No lot or parcel of land located outside the corporate limits of the city shall be connected to the sewer system unless a permit therefor is obtained. ... Permit fees, sewer connection charges, deposits and monthly charges for properties or users located outside the corporate limits of the city shall be as agreed upon by the city council and the applicant for service, but in no case shall be less than the fees, deposits or charges made within the corporate limits of the city.”

“Timing of payment of sewer connection fees. The sewer connection charges required under subsections (b), (c), and (d) of this section shall be due as provided for in article V of chapter 21 of this Code.”

City of Fontana, the agency that levies it

“The Mitigation Fee Act, Government Code Section 66000 et seq., (the "Act") governs the establishment and administration of development impact fees paid by new development projects for public facilities needed to serve new development. Fees must be separately accounted for and used for the specific purpose for which the fee was imposed. The City's adopted development impact fees are listed in the attached exhibits. Expenditures are authorized through the annual Operating Budget and the City's Capital Improvement Program.”

“Construction in-lieu option. Pursuant to article VI of chapter 21 of this Code, the city may allow partial or complete satisfaction of the sewer connection fees required by subsections (b), (c) and (d) of this section through execution of an agreement requiring the construction of public improvements and/or dedication of property.”

“Section 2. Upon the effective date of the adoption of a specific fee set forth in Exhibit "A" of this Resolution, the portion of any prior Resolution, which pertains to and is inconsistent with the adoption of such fee, shall no longer be in effect. Development Impact Fees, as listed in Exhibit "A", in accordance with Government Code Section 66000 et seq., shall become effective on January 1, 2023.”
